By accessing or using TrioSens ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and TrioSens.

TrioSens is a brand intelligence platform that provides AI-powered brand monitoring, analysis, and reporting. The Service collects and analyzes data from publicly available sources to generate insights about brand perception, visibility, and competitive positioning.

3. Account Registration & Security

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use. TrioSens reserves the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions & Billing

The Service is offered through subscription plans. By subscribing, you agree to pay the applicable fees. Subscriptions auto-renew unless cancelled before the renewal date. All fees are non-refundable except where required by law. TrioSens reserves the right to change pricing with 30 days notice. Free trial terms, if applicable, are specified at signup.

5. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes
• Attempt to gain unauthorized access to any part of the Service
• Reverse-engineer, decompile, or disassemble the Service
• Use automated means to scrape or extract data from the Service beyond its intended functionality
• Interfere with or disrupt the Service or its infrastructure
• Impersonate any person or entity
• Use the Service to harass, abuse, or harm others

6. Intellectual Property

TrioSens and its licensors retain all rights, title, and interest in the Service, including all software, designs, trademarks, and documentation. You retain ownership of any data you submit to the Service ("Your Data"). You grant TrioSens a limited license to use Your Data solely to provide and improve the Service.

7. AI-Generated Content

The Service uses artificial intelligence to generate reports, analyses, and insights.

• TrioSens does not guarantee the accuracy, completeness, or reliability of AI-generated content
• You are solely responsible for decisions made based on AI-generated content
• TrioSens does not use Your Data to train general-purpose AI models
• AI outputs may occasionally contain errors or inaccuracies; always verify critical information independently

8. Data Collection & Privacy

Our collection and use of personal information is governed by our Privacy Policy. The Service collects and analyzes data from publicly available third-party sources for brand monitoring purposes. TrioSens does not claim ownership of third-party data and processes it in compliance with applicable laws.

9. Third-Party Services

The Service may integrate with or contain links to third-party services. TrioSens is not responsible for the content, privacy practices, or availability of third-party services. Your use of third-party services is subject to their respective terms and policies.

10. Limitation of Liability

To the maximum extent permitted by law, TrioSens shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. TrioSens's total aggregate liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless TrioSens, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

Either party may terminate the agreement at any time.

• You may cancel your subscription through your account settings
• TrioSens may suspend or terminate your access for violation of these Terms
• Upon termination, your right to use the Service ceases immediately
• TrioSens will make your data available for export for 30 days following termination, after which it may be deleted

13. Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

14. Changes to Terms

TrioSens reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Effective Date." Your continued use of the Service after changes constitutes acceptance of the modified Terms.
